“Sabatino foe faces state bar charges”

 

That’s the way the Modesto Bee reported the unraveling of Attorney and con-man Patrick McGrath.  McGrath deserves his own headline.

 

McGrath provided the Bee editors and local law enforcement with the “Big Lies” to charge Mayor Sabatino with phony charges and remove him from office.

 

Bee Editor Mark Vasche was only too happy to assist in devoting his newspaper to destroy Sabatino and thus obstruct justice.

 

What would motivate Vasche to lie or not report the truth?

 

First, he blames former Mayor Sabatino for reducing taxpayer paid advertising with the Bee from $180,000 to $80,000 per year.  The Mayor also insisted that the City obtain a rate of $22.00 per column inch on contract instead of $41.00 dollars per column inch.

 

Second, the loss of City business is peanuts compared to the fear Vasche holds of losing the advertising revenue of developer Mike Zagaris.

 

Editors Vasche and Sly convicted the former Mayor in the newspaper years before the trial.

 

They protected Pat McGrath because he was willing to lie to have Sabatino charged.  The District Attorney assigned McGrath’s high school classmate investigator Kirk Bunch to build the case against the former Mayor. Bunch made material omissions and misstatements to the judge, under the penalty of perjury, in order to obtain a search warrant.

 

Delay in charging McGrath results in more victims

 

Former Mayor Carmen Sabatino filed complaints of forgery and embezzlement against McGrath in 2002.  A copy of a December 21, 2005 letter to Birgit Fladager is presented below.  District Attorney Jim Brazelton gave McGrath a pass in order to use him during the trial of Sabatino.

 

 “When asked whether prosecutors applied a double standard when evaluating McGrath and Sabatino, a spokesman for the district attorney’s office remained tight-lipped.” 

 

“The defense will always crow about something,” Chief  Deputy District Attorney John Goold said. ”Until it’s proven in court it doesn’t mean anything.”

 

“It has to be proven,” said Sherrie McLetchie, deputy trial counsel for the state bar association.  “But obviously we believe it’s true.”

Chief Deputy District Attorney John Goold might consider resigning his position in order to continue the defense of McGrath.

 

County Counsel Mike Krausnick has taken over the investigation of Sabatino in hopes of finding new charges.

Re:Failure to prosecute criminal complaint; MPD #02-106255

 

Dear Ms. Fladager:

 

On September 5, 2002, I filed a criminal complaint with the Modesto Police Department. This complaint alleged a violation of section 470 of the California Penal Code (Forgery). This complaint alleges that Patrick McGrath executed loan documents in my name. These allegations were supported by findings in the above-referenced Police Report (see exhibits K1g and K1h).

 

To date, I have not received any response from you or any other member of your office regarding this matter.

 

Because of your, or your office’s inaction regarding this issue, additional fraudulent actions were perpetrated against many other citizens of our community by Mr. McGrath. The District Attorney's office failed to use its discretionary power to protect the public. It fails to fulfill its responsibility to seek the truth.

 

I would appreciate your, or your offices, official response to my request for the truth concerning Patrick McGrath at your earliest possible convenience. Thank you, in advance, for your professional courtesy in regard to this matter.
